Dear Mr. Droneburg,

I am responding to your letter dated October 30, 2006, in which you expressed your concern regarding funding for potassium iodide (KI) stockpiles for emergency workers. In your letter you indicated that KI for emergency workers in Harford and Cecil County, Maryland, had passed its expiration date. Your letter also stated that the Nuclear Regulatory Commission (NRC) should require the Peach Bottom Atomic Power Station to pay for such stockpiles.

As you are aware, NRC and Department of Homeland Security (DHS) guidance require that KI stockpiles be maintained for use by emergency workers. In addition, the NRC amended its emergency planning rules in April 2001 requiring States to consider the use of KI for members of the general public within the 10 mile emergency planning zone (EPZ) and agreed to supply KI tablets to those States that choose to implement KI as part of its protective measures. As discussed between Frederick Frey of your staff and Patricia Milligan of my staff, many States have included emergency workers as part of the public within the 10 mile EPZ and drawn from NRC supplied stockpiles to replenish emergency worker stockpiles, while other States have chosen to purchase such stockpiles directly or to work in coordination with the nuclear power plant licensee to procure KI for emergency workers. The NRC believes that arrangements for replenishment of emergency worker stockpiles are best left to the States rather than dictating to States through prescribed regulation how emergency worker KI stockpiles will be maintained.

The NRC will continue to work with DHS, other Federal agencies, State and local officials, as well as licensees, to strengthen emergency planning and preparedness.
