Dear Judge Young,
In the Licensing Board's Order of November 29, 2006, it was requested that the parties submit comments regarding potential dates for a site visit and any further limited appearance sessions in the Pilgrim Nuclear Power Plant re-licensing. Pilgrim Watch requests that a site visit be scheduled for the spring of 2007 at some date after the draft SER (SER with open items) is released. In addition, Pilgrim Watch requests that limited appearance sessions be scheduled after the release of the draft and final environmental and safety documents.
We feel it is of particular importance for the parties and the Board to examine the site and topography as it is unique to this plant. The particular characteristics of the site are relevant to both of the Contentions admitted by the Board. With respect to Contention 1, "The Aging Management program proposed in the Pilgrim Application for license renewal is inadequate with regard to aging management of buried pipes and tanks that contain radioactively contaminated water, because it does not provide for monitoring wells that would detect leakage," the location of buried pipes and tanks that contain radioactive water, and their location relative to the topography of the site, are highly relevant to any decision about monitoring
wells. With respect to Contention 2, "Applicant's SAMA analysis for the Pilgrim plant is deficient in that the input data concerning (1) evacuation times, (2) economic consequences, and (3) meteorological patterns are incorrect, resulting in incorrect conclusions about the costs versus benefits of possible mitigation alternatives, such that further analysis is called for," the unique site characteristics and location of the plant determine the meteorological and evacuation patterns around the plant, as well as give an understanding of the devastating impact a severe accident would have on the area's tourism economy.
Where public meetings have not already been scheduled, it is important that the public be given a chance to comment on the draft and final SEIS, and the draft and final SER, both before they have been finalized and after the final document is issued. Therefore Pilgrim Watch requests that limited appearance sessions be scheduled after the issuance of these documents. The NRC Staff's position, as articulated to me by their attorney Susan Uttal, is that if the Board decides to hold an additional limited appearance session, that it be held in conjunction with other Board sessions. Therefore, if the Board determines that a site visit is necessary, the limited appearances could be scheduled for the same time. If a site visit is not scheduled, the limited appearances could be scheduled to take place at the time of the hearing. Paul Gaukler, attorney for Entergy, has stated to me that Entergy does not believe that additional limited appearance session are necessary since the Board has already held a session, but if the Board does hold another limited appearance session it should be held in conjunction with the hearing as is the typical process, not at the plant site.
