OFFICE OF INVESTIGATIONS REPORT NO. 3-2005-016 DAVIS-BESSE NUCLEAR POWER STATION
Dear Mr. Bezilla:
This refers to an investigation by the U.S. Nuclear Regulatory Commission (NRC) Office of Investigations (OI) that was completed on March 28, 2006, at the Davis-Besse Nuclear Power Station (DBNPS) operated by the FirstEnergy Nuclear Operating Company (FENOC). The investigation concerned alleged employment discrimination involving a former nuclear security officer (NSO) after the NSO made a self-declaration regarding personal fitness-for-duty (FFD) status.
After considering the information developed during the investigation, the NRC staff concluded that a violation of 10 CFR 50.7, Employee Protection, did not occur. Therefore, the NRC staff is not proposing enforcement action against FENOC in this matter.
