DOCKETED USNRC UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION BEFORE THE ATOMIC SAFETY AND LICENSING BOARD OFFICE OF SECRETARY RULEMAKINGS AND ADJUDICATIONS STAFF In the matter of Docket # 50-293 Entergy Corporation Pilgrim Nuclear Power Station License Renewal Application October 31, 2006 NOTICE OF APPEAL OF LBP-06-23 BY PILGRIM WATCH Pilgrim Watch hereby gives notice pursuant to 10 C.F.R. § 2.311 (a) that it is appealing the Order LBP-06-23 issued by the Atomic Safety and Licensing Board on October 16, 2006.

1. Pilgrim Watch filed a Request for a Hearing and Petition to Intervene in the license renewal for Pilgrim Nuclear Power Plant on May 26, 2006. In that Petition Pilgrim Watch submitted five contentions pursuant to the requirements of 10 CFR § 2.309.
2. On October 16, 2006, the Atomic Safety and Licensing Board issued Order LBP-06-23 accepting 2 of Pilgrim Watch's contentions and rejecting 3 contentions, including contention 4 which states "The Environmental Report fails to address Severe Accident Mitigation Alternatives (SAMAs) which reduce the potential for spent fuel pool water loss and fires."
  • 3. Pilgrim Watch has filed a supporting Brief on Appeal of the Licensing Board's decision to reject contention 4.

WHEREFORE, Pilgrim Watch respectfully gives notice of this appeal.
