DIABLO CANYON UNITS 1 AND 2 AND HUMBOLDT BAY POWER PLANT UNIT 3 - USE OF DELTA PROTECTION MURUROA BLU SINGLE-USE RESPIRATORY PROTECTION SUITS WITH ASSIGNED PROTECTION FACTOR (TAC NOS. L60559, MD2688, AND MD2689)

Dear Mr. Keenan:

By letter dated July 21, 2006, and supplemented September 27, 2006, Pacific Gas and Electric Company (PG&E) requested U.S. Nuclear Regulatory Commission (NRC) authorization pursuant to 10 CFR Sections 20.1703 and 20.1705 to use French-designed respiratory protection equipment that has not been tested and certified by the National Institute for Occupational Safety and Health and to take credit for an assigned protection factor of 2000 for this equipment.

On April 10, 2006, the NRC issued a Final Safety Evaluation for Delta Protection/Bacou Dalloz Topical Report (TR) MURUBLU05NP, Topical Report of Delta Protection Mururoa BLU Single Use Suits. (Agencywide Documents Access and Management System Accession Number ML060950499) The NRC staff concluded that the use of the Mururoa BLU (PVC or Ethyfuge) protective suit systems, consistent with the configuration and conditions of use specified, was in accordance with the requirements of 10 CFR Part 20. Additionally, the NRC staff determined that TR MURUBLU05NP was acceptable for referencing in licensing applications for respiratory protective equipment designed for reactors to the extent specified and under the limitations delineated in the topical report and in the final safety evaluation.

The NRC staff has reviewed your request and finds that the list of commitments provided in your September 27, 2006, letter is sufficient to ensure that you will implement the use of this respiratory protective device, consistent with the topical report, and within the specified limits of our applicable safety evaluation and that the requirements of 10 CFR 20.1703 and 20.1705 will be met. Therefore, your request is approved.
