Docket No. 50-271-LR ASLBP No. 06-849-03-LR ENTERGY'S INITIAL DISCLOSURES Pursuant to 10 C.F.R. § 2.336(a), Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. ("Entergy") hereby make the following initial disclosures.

1. Testifying Witnesses Entergy has not yet identified the persons upon whom it will rely as witnesses with respect to the admitted contentions. Persons currently employed by Entergy, its affiliates, or its contractors upon whose opinions Entergy bases its position on the admitted contentions are identified below. None of these individuals has yet been asked to provide an analysis responding to the admitted contentions:

2. Documents and Data Compilations Documents and data compilations that are relevant to DPS Contention 1 and NEC Contentions 1 through 4, and that are not privilegedor otherwise subject to protected status, are being provided on compact disks to the DPS, NEC, and NRC Staff. Attachment 1 provides a description and location of additional documents, or categories of documents, that have been identified by Entergy as relevant to these contentions, but have not yet been provided on compact disks.
3. Tangible Things.

Other than documents provided or listed, no relevant tangible things have been identified.

4. Privilege Log Lists of documents that are privileged, or that have protected status because they contain proprietary information, are being provided to DPS, NEC, and the NRC Staff, with a copy to the Licensing Board, under separate cover. Except for certain privilege logs related to the thermal discharge issue that were previously prepared in another proceeding, these lists do not include (1) communications that originated from counsel to the client, or from the client to counsel, 2

when no outside person was included, or (2) documents as to which the attorney work-product privilege is asserted when the documents are authored by counsel. Upon issuance by the Board of an appropriate protective order, such as the March 1, 2005 order in the Extended Power Uprate proceeding, Entergy is prepared to obtain the consent from the intellectual property owners to provide copies of proprietary documents to those parties and their representatives executing a suitable confidentiality agreement.
