NRC STAFF ESTIMATE OF PROJECTED SCHEDULE FOR COMPLETION OF SAFETY AND ENVIRONMENTAL REVIEW In accordance with the Boards Order (Scheduling Prehearing Conference Call), dated October 11, 2006 (unpublished), at 2, the Staff of the Nuclear Regulatory Commission (Staff) hereby provides its estimate of the projected schedule for completion of the staffs safety and environmental review.

The Staffs projected review schedule for the license renewal application that is being contested in this proceeding is as follows:

Draft Supplemental Environmental Impact Statement (DSEIS) -

12/15/06 Safety Evaluation Report (SER) with Open Item(s) -

4/01/07 Safety Evaluation Report -

8/01/07 Final SEIS -

8/03/07 These dates can also be found on the NRCs public website at:

http://www.nrc.gov/reactors/operating/license/renewal/applications/vermont-yankee.html.

Inasmuch as renewal of a license is not an amendment, regulations concerning significant hazards considerations do not apply. See, e.g., Nuclear Power Plant License Renewal [Final Rule], 56 Fed. Reg. 64,943, 64,962 (Dec. 13, 1991); 10 C.F.R. § 50.92.

The Staff will keep the Board and parties apprised of any changes to the schedule listed above.

Respectfully submitted,

/RA/
