Response to RIS 2006-06, New Reactor Standardization Needed to Support the Design-Centered Licensing Review Approach (1) NRC Regulatory Issue Summary 2006-06, New Reactor Standardization Needed to Support the Design-Centered Licensing Review Approach, dated May 31, 2006 (2) NuStart response to RIS 2006-06 for AP1000 Project at Bellefonte dated July 17, 2006 (3) Joint response from NuStart, Entergy and Dominion to RIS 2006-06 for ESBWR Projects at Grand Gulf, River Bend and North Anna dated July 17, 2006 The purpose of this letter is to announce Exelon Generation Company's intent to prepare and submit a Combined Construction and Operating License (COL) application to the NRC in November of 2008. Exelon is currently in the process of selecting both a technology as well as a site. We are notifying the NRC at this time so as to provide the staff with advance notice to enable development of its resource estimates, as requested in Reference (1).
Additionally, responses to the specific bulleted items from the RIS are provided in Enclosure 1 to this letter.
We are currently evaluating both the General Electric Economic Simplified Boiling Water Reactor (ESBWR) and the Westinghouse Advanced Passive (AP) 1000. As a member of NuStart, Exelon is active in the licensing and design activities for both technologies.
At this time, Exelon is considering various site locations within the state of Texas. Exelon will notify the NRC of its technology and site selections once the associated evaluations are complete.

&r_(bS-. Ebo-01 Exelon COL Project Response to NRC RIS 2006-06 New Reactor Standardization Needed to Support the Design-Centered Licensing Review Approach Each RIS 2006-06 information request is restated below followed by Exelon's response.
Information Request #1:
Whether applicants for the four designs discussed in this RIS will be organized into design-centered working groups (DCWGs); if so, the schedule for such organization and, if a single point of contact is designated for the DCWG, the contact's identity.
Response
Exelon supports the design-centered review approach based on the concept of industry standardization of COL applications referencing a particular technology.
As indicated in References (2) and (3), both DCWGs have already been established.
Because of our membership in NuStart we are well positioned to work with either the AP1000 DCWG as implemented through NuStart or the ESBWR DCWG as implemented cooperatively through NuStart and Dominion.
Mr. Peter Hastings of Duke Energy has been identified as the AP1000 Reference Plant Licensing Lead for NuStart and the NRC point of contact for the AP1000 DCWG. The NuStart Licensing Lead for the ESBWR project at Grand Gulf is Mr. Tom Williamson. Mr. Williamson will work cooperatively with the licensing leads from both Dominion and Entergy, as specified in Reference (3).
Information Request #2:
If a design-centered program is followed for a particular design, which applicant referencing the design will be designated as the R-COL applicant? In addition, when will (month and year) each of the COL applications be submitted for review?
Response
As indicated in Reference (2), the reference COL (R-COL) for the AP1000 will be Bellefonte. The Bellefonte COL application is expected to be submitted to the NRC in October 2007. As indicated in Reference (3), a single reference COL application for the ESBWR is not proposed at this time.
This was discussed with the NRC at the July 14, 2006 DCWG pre-application meeting. NuStart and Dominion are working cooperatively to develop the lead ESBWR COL applications for Grand Gulf and North Anna. The projects have agreed to simultaneously file the lead ESBWR COL applications in November 2007.
Exelon plans to submit the COL application for its Texas project in November of 2008.
Information Request #3:
Whether applicants implementing the DCRA intend to provide RAI responses within the typical 30-day period.
Response
For Requests for Additional Information (RAIs) related to the standard technology portion of the COL, Exelon will work with the appropriate DCWG to develop responses within the timeframes indicated in References (2) and (3). For RAIs specific to the Exelon project, we expect to provide responses within 30 days. RAIs requiring substantial new evaluation or analysis, or consisting of a significant number of questions, however, will most likely require additional time for a complete I

These exceptions will be addressed with the NRC staff. Additionally, a typical 30-day response would be contingent on pre-request discussions between the NRC and Exelon so that the information needs are well understood.
Information Request #4:
To what degree standardization will be achieved, appropriately documented, and replicated in COL applications.
Specifically, what portions of the R-COL application (chapter by chapter, section by section, subsection by subsection) will be standardized (i.e., replicated verbatim) in S-COL applications and what portions of the application are likely to be site-specific.
Response
Standardization is expected to be substantial for both the AP1000 and the ESBWR, as evidenced by the Standardization Matrices included with both References (2) and (3). The Exelon COL application is expected to be consistent with the applicable Standardization Matrix.
Information Request #5:
Whether, for each design-centered program, the vendor and applicants intend to submit pre-application topical reports for staff review. If so, how many? For each such report anticipated, please summarize the report scope and content and the proposed submittal schedule.
Response
Exelon has not identified, at this time, any site-specific pre-application topical reports for staff review.
Future discussions with the NRC staff may result in the identification of site-specific information appropriate for early submittal.
Information Request #6:
Whether any applicants intend to apply for an ESP prior to submitting their COL applications. If so, when (month and year) would the proposed ESP be submitted to the NRC for review?
Response
Exelon does not intend to apply for an Early Site Permit (ESP) for the Texas project prior to submitting the COL application.
