ALLEGATION NO. RiII-02-A-01 14 Dea.
This letter is in reference to our letter dated September 13, 2002, that stated we were reviewing your concerns associated with activities at the Kewaunee Nuclear Power Plant. You were concerned that: (1) severaLinddualsiw-u ustly accused that they failed to report the smell Iniiull1.a(3senvestigator about being told about the (36asue~rvisor lied to a itce smell of alcohol onn Individual; (4) you were the subject of discrimination when you were not rehired after providing information to the licensee's investigator about the smell of alcohol on an individual; and (5) action taken against the employees who raised the fitness-for-duty concerns has created a chilled environment for raising safety concerns.
We have completed our review of Concern 2. The results of our evaluation are included in the enclosure to this letter. Based on our review of the licensee's investigation of this issue, we did not substantiate the concern. The details of our evaluation are Included in the enclosure to this letter. Our evaluation of Concerns 1, 3, 4 and 5 continues. When we complete our evaluation of these issues, we will provide you with our conclusions.
