ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process (SDP) finding will be issued on or about September 12, 2006, to Southern Nuclear Operating Company, Inc., as a result of an inspection at the Vogtle Electric Generating Plant. This White finding, an issue of low to moderate safety significance which may require additional NRC inspection, involved the failure of the licensees full-scale exercise critique to identify a weakness associated with a risk-significant planning standard (RSPS) which was determined to be a drill/exercise performance (DEP) - performance indicator (PI) opportunity failure.

A Notice of Violation is included based on a violation of emergency preparedness planning standards 10 CFR 50.47(b)(14) and 10 CFR 50.47(b)(4) as well as the requirements of 10 CFR Part 50, Appendix E, Section IV.F.2.g because the licensee failed to identify weak or deficient areas during its formal critique of an emergency preparedness exercise conducted on March 22, 2006. Specifically, the exercise critique failed to identify that the Emergency Directors Site Area Emergency event classification was an incorrect classification.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has 30 days from the date of the letter in which to respond.
