SUBJECT:
REVISION TO BIOLOGICAL OPINION REGARDING AMERICAN CROCODILES AT THE TURKEY POINT NUCLEAR PLANT (TAC NOS. MC9679 AND MC9680)
Dear Mr. Stall:
On June 16, 2006, the U.S. Nuclear Regulatory Commission (NRC) forwarded to Florida Power and Light Company (FPL) the U. S. Fish and Wildlife Service (FWS) Biological Opinion (BO),
dated May 5, 2006, which established an incidental take limit of one American crocodile every 5 years at the Turkey Point Nuclear Plant. It also required FPL to take certain actions to increase employee awareness of the presence of American crocodiles at the Turkey Point Plant. This concluded formal consultation as a result of a December 21, 2005, event.
On May 27, 2006, another crocodile was accidentally struck and killed by a security vehicle. In a letter dated June 29, 2006, the NRC contacted the FWS and requested modification of the BO regarding the incidental take limit. In the enclosed letter dated August 1, 2006, the FWS modified the incidental take limit of the BO and added an additional requirement to post speed limit signs in the area where the crocodile mortalities occurred. Reinitiation of consultation will be required if the incidental take limit is exceeded or for other conditions detailed in the BO.
If you have any questions, please contact me at (301) 415-3974 or Ms. Harriet Nash of the Environmental Branch at (301) 415-4100.
Sincerely,
/RA/
