Id. at A18 The documents being provided correspond to those whose production was directed by the Board, as follows:

Document I is the non-proprietary version of Item L.A requested by the Board, General Electric Company Licensing Topical Report for Constant Pressure Power Uprate Safety Analysis, NEDC-33004P-A Rev. 4, July 2003 (Order at 2).

En-tergy notes that neither the Staff nor NEC has executed the confidentiality and non-disclosure agreement that is part of the of the Board's March 1, 2005 Protec-tive Order governing the non-disclosure of proprietary information. Accordingly, only the Board members are receiving copies of this and other proprietary docu-ments in a separate CD designated as "Proprietary." The proprietary documents being furnished to the Board are listed as Documents 26-33 in the above index.

Documents 2 and 3 are volumes I and 2, respectively, of Item L.B. requested by the Board, Qualification of the One-Dimensional Core Transient Model for Boil-ing Water Reactors, NEDO-24154-A, August 1986 (id.) Both of these documents are non-proprietary.

Document 4 contains non-proprietary summaries of the relevant information con-tained in volumes 3 and 4 (proprietary) of Item 1.B requested by the Board. These summaries have been prepared by Entergy witness Jose L. Casillas specifically for the purpose of responding to the Board's Order. No non-proprietary, redacted versions of those two volumes currently exist and, because of their large size, preparation of a redacted, non-proprietary version would be very time consuming.

Documents 5 and 6 correspond to Item I.C requested by the Board, General Elec-tric's Supplemental Reload Licensing Report, December 2005. These documents are non-proprietary.

Documents 4 and 7 contain non-proprietary summaries of the information re-quested by the Board in Section 11 of the Order, i.e., documentation supporting Entergy's testimony on the ODYN code. These summaries have been prepared by Entergy witness Jose L. Casillas specifically for the purpose of responding to the Board's Order. No non-proprietary, redacted versions of the documents sum-marized in these two documents currently exist and, because of their large size, preparation of a redacted, non-proprietary version would be very time consuming.

Documents 8-25 respond to the Board's directive in Section III of the Order that the parties "shall supplement their respective direct testimony on both admitted contentions by submitting all reports and documents that are relied upon to prove or substantiate that party's position, or that are referenced by, and are material to support, the testimony of one of its witnesses." The documents being provided were cited in Entergy's Direct Testimony on NEC Restated Contention 4 but were not included as exhibits to that testimony.

Those documents listed in the above Index that are non-proprietary will be provided to all parties. Because of their size, the documents are not being sent in hard copy but have been cop-ied onto a CD that is enclosed with this Supplement to Direct Testimony. Proprietary documents will be sent to the Board only in a separate CD marked "Proprietary."

Respectfully submitted, Jay E. Silberg Matias F. Travieso-Diaz PILLSBURY WINTHROP SHAW PITTMAN LLP 2300 N Street, N.W.
