REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR NORTH ANNA POWER STATION, UNIT NOS. 1 AND 2, SURRY POWER STATION, UNIT NOS. 1 AND 2, KEWAUNEE POWER STATION, AND MILLSTONE POWER STATION, UNIT NOS. 2 AND 3 (TAC NOS. MC8833, MC8834, MC8835, MC8836, MC8831 AND MC8832)

Dear Mr. Christian:

By letter dated June 8, 2006, Virginia Electric and Power Company, Dominion Energy Kewaunee, Inc., and Dominion Nuclear Connecticut, Inc., submitted an affidavit executed that same day by Mr. Eugene S. Grecheck. In this submittal, Mr. Grecheck requested that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2.390:

A CD-ROM containing the electronic GOTHIC input and output files from the benchmark cases in Sections 4.3, 4.4, 4.5, and 4.6 of Topical Report DOM-NAF-3, GOTHIC Methodology for Analyzing the Response to Postulated Pipe Ruptures Inside Containment.

A nonproprietary copy of this document has been placed in the Nuclear Regulatory Commission's (NRC's) Public Document Room and added to the Agencywide Documents Access and Management System Public Electronic Reading Room.

The affidavit stated that the submitted information in CD-ROM should be considered exempt from mandatory public disclosure for the following reasons:

a.

This information is being held in confidence by DRS [Dominion Resources Services].

b.

This information is of a type that is held in confidence by DRS, and there is a rational basis for doing so because the information contains sensitive commercial information concerning DRS containment analysis methodology.

c.

This information is being transmitted to the NRC in confidence.

This information is not available in public sources and could not be gathered readily from other publicly available information.

e.

Public disclosure of this information would create substantial harm to the competitive position of DRS by disclosing confidential DRS internal containment analysis methodology information to other parties whose commercial interests may be adverse to those of DRS. Furthermore, DRS has expended significant engineering resources in the development of the information. Therefore, the use of this confidential information by competitors would permit them to use the information developed by DRS without the expenditure of similar resources, thus giving them a competitive advantage.

We have reviewed Mr. Grechecks application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of Mr. Grochecks statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the proprietary information contained in the CD-ROM will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
