Dear Mr. Mulligan:

Your e-mail correspondence dated May 31, 2006, June 2, 2006, June 7, 2006, June 12, 2006, June 15, 2006, and June 22, 2006, addressed to Mr. Luis Reyes, Executive Director for Operations at the U.S. Nuclear Regulatory Commission (NRC), and others have been referred to the NRC Office of Nuclear Reactor Regulation pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.206. You requested that NRC shut down Vermont Yankee Nuclear Power Station (VY) if, the defect with a surge protector in the switch gear room [is not]

replaced within 6 months. Two separate e-mails requested a shutdown of the Indian Point Nuclear Power Station (IP) within 1 year unless, NRC, NEI, INPO and state of NY overseers be reorganized with a theme of radical transparency on all things associated with nuclear power. In addition, you requested that NRC shut down an unidentified plant if it does not within 1 year fix degradations pictured in a slide presentation on April 29, 2006, by Commissioner Lyons.

It has been determined that your requests do not meet the criteria for consideration pursuant to 10 CFR 2.206. The component(s) you cited as defective at VY in your petition of May 31, and supplemented on June 22, operated as designed, therefore, following a review, no violations of NRC regulations were cited. Your petition requests of June 2, and June 7, addressed deficiencies with the NRC. These issues are not considered under 10 CFR 2.206. We have referred your concerns to the Office of the Inspector General for their review. Finally, your petition of June 12, does not provide sufficient supportive factual information. In addition, the system(s) that you reference in the petition have been the subject of NRC staff review and evaluation.

The VY, defective surge protector you refer to in your e-mail, is in fact a ground bus resistor bank designed to dissipate the ground current energy from a fault in the condensate pump motor windings. In contrast to VY, the Prairie Island pump trip, referenced in your June 22 e-mail was caused by a cable fault.

NRC makes transparency of its programs and licensing processes for the general public a priority with exceptions for plant physical security. In particular, the NRC process for reviewing plant amendments is a transparent process where the public is allowed to participate by comment or through a hearing request.

The picture that you provided in your June 12, 2006, petition was taken several years ago and is of a non-safety-related sparging system located within the Intake Structure of Cooper Nuclear Station. This system helps prevent silt buildup in the intake bay. The piping and components to this non-safety-related system are periodically inspected by the licensee (last inspected during the spring of 2006 see inspection report 5000298/2005015 dated April 25, 2006, ADAMS Accession No. ML061160027), and are repaired as needed.

M. Mulligan Finally, your June 15, 2006, request to add concerns about the use of cheater bars at Oconee Nuclear Station to your June 12, 2006, request, was resolved through NRC Special Inspection Report 50-269/03-10, 50-270/03-10 and 50-287/03-10, ADAMS Accession No. ML031530617.

In addition to your specific petitions, we reviewed all the issues raised in your e-mails, and determined that none of them fit the criteria for consideration pursuant to 10 CFR 2.206.
