UNITED STATES NUCLEAR REGULATORY COMMISSION BEFORE THE ATOMIC SAFETY AND LICENSING BOARD In the Matter of the Nuclear Management Company, LLC Docket No. 50-263 Application for Re-Licensing the Monticello Nuclear Generating Plant ASLBP NO.05-841-02-LR MOTION OF THE NORTH AMERICAN WATER OITICE TO FIND THE APPLICATION FOR RE-LICENSING THE MONTICELLO NUCLEAR GENERATING PLANT INCOMPLETE And REQUEST FOR INFORMATION The North American Water Off~cehereby presents this motion before the Atomic Safety and Licensing Board to declare the re-licensing application in the above referenced matter to be incomplete, to order said application to be withdrawn and the proceeding stayed until such time as a complete application has been prepared, resubmitted and approved as complete. If by weird prejudice and in the face of the glaring deficiencies specified below, the Application is still not deemed to be incomplete the North American Water Offke hereby reiterates its motion for hearing on the contention, among others already before the Board, that aging management of components at Monticello is not sufficient to ensure protection of the public health and safety from radiological contamination during the re-license period, should reactor operations last that long prior to failure.

Therefore, the Application must be found to be incomplete and the present proceeding stayed until such time as the Applicant produces an Application that contains a complete listing of components whose failure could adversely impact the intended pressure boundary, that demonstrates beyond all reasonable doubt that its listing of components is in fact complete, and that provides for aging management of those components that can reasonably be expected to prevent their failure during the re-licensing period.

In addition, the North American Water Office hereby request Nuclear Management Company, LLC to provide it with copies of all information it provides the Nuclear Regulatory Commission in response to the Information Requests of September 15 and September 16,2005.
