Dear Lynn:

A review of our records show Indirect Discharge Permit Number ID-9-0036-2 will expire on September 30, 2005. In order to retain authorization to discharge beyond the expiration date of your current permit, you should apply for renewal of the permit by June 30, 2005. 'Renewal of the indirect discharge permit Is for a five-year period and an application form is enclosed for your use. The completed and signed application form, and the Administrative Processing Fee of $100.00 (in the form of a check made payable to the State of Vermont) should be submitted to the following address:

VT Department of Environmental Conservation Wastewater Management Division 103 South Main Street - The Sewing Building Waterbury, Vermont 05671-0405 Please note that Condition A(3) of Indirect Discharge Permit ID-9-0036-2 requires that you submit this renewal application by June 30, 2005. Pursuant to section 814(b) of the Vermont Administrative Procedure Act (3 V.S.A. section 801 et. seq.), your permit will be automatically extended upon the filing of your complete application for renewal until this Agency acts upon.your application.

Each application for renewal of an Indirect discharge permit for a New Indirect Discharge of Sewage must contain the following (adapted from §14-406(b) of the Indirect Discharge Rules, effective April 30, 2003):

1.

a completed WR-82 application form; Note that the Schedule I application form Is also required when changes are proposed to the Indirect discharge system that result In a change of the indirect discharge;

2.

a consultant's report and evaluation of performance of the system under all terms and conditions of the current Indirect discharge permit (2005 annual Inspection report);

a consultant's evaluation of all monitoring data available for each system including effluent and groundwater data for the previous five year period (2000-2004) unless a different time period is established by the Secretary. The data analysis shall Include the calculation of the 5% exceedence value for groundwater data and demonstration that the aquatic permitting criteria (APC) have been met In the receiving waters. Use of the mean (or average) value for the groundwater data set will be allowed If there are at least 30 data points in the data set;

4.

a consultant's evidence of compliance with all permit limitations and compliance with the Aquatic Biota criteria (by demonstrating compliance with the APC);

5.

a condition-by-condition review of the permit establishing compliance with all permit conditions; and

6.

the correct application fee.

According to our records Entergy Nuclear Vermont Yankee is current with its annual operating fee. The next operating fee will be due September 30,2005 in the amount of $1,158.61.

A revised fee schedule for permits issued under 10 V.S.A. Chapter 47 became effective on July 1, 2004.

Enclosed is a worksheet showing how the Annual Operating Fee for your discharge will be calculated, following the issuance of your renewal permit. Information regarding how the Annual Operating Fee will be collected will be sent following issuance of your final Indirect discharge permit.
