Dear Administrative Judges:

On June 5, 2006, The Vermont Department of Public Service (DPS) served by electronic mail its Notice Of Intent To Adopt Contentions and Motion For Leave To Be Allowed To Do So, dated June 5, 2006, and then served the same document by first class mail on June 6, 2005.

Due to an error in the e-mail address, the Office of the General Counsel (OGC) did not receive (and was not aware of) that filing until yesterday when it received the hard copy sent by mail.

After contacting SECY and reviewing the DPS email, it is apparent that OGC did not receive that filing because of a typo in the OGC mailing address (i.e., OCG instead of OGC).

The undersigned counsel has informed Sarah Hofmann (DPS), David Lewis (Counsel for Licensee), Ronald Shems (Counsel for New England Coalition), and Matthew Brock (Assistant Attorney General for Massachusetts) of the address error and was told those representatives do not object to the Staff responding to the above-mentioned DPS filing based on the June 6, 2006 mailing date. Attempts to reach the Town of Marlboro Selectboard Chair, Callie B.

Newton, proved unsuccessful.

Accordingly, this letter is to notify you that, in accordance with 10 C.F.R. §§ 2.306 and 2.323, the Staff plans to file its answer to the DPS filing within 15 days from June 6, 2006.
