The Board is tentatively scheduling an oral argument in this license renewal proceeding on Tuesday, July 25, 2006, and Wednesday, July 26, 2006, in or about Brattleboro, Vermont.

The oral argument will be held if the Board determines, after reviewing all of the pleadings, that such argument would assist us in making the initial determinations about the standing of the petitioners or the admissibility of one or more of the proposed contentions. The exact time and location of any such oral argument, as well as the sequence and organization of the presentations, would be set by a subsequent order.

The petitioners (with the exception of the Town of Marboro), the applicant, and the NRC Staff are each represented by multiple counsel and thus should be able to participate on the above-stated dates. However, if it is impossible for a potential participant to partake in the July 25 and 26, 2006, oral argument, that participant should: (1) promptly contact the other participants to this proceeding to identify at least three other consecutive two-day periods during the weeks of July 24, July 31, and August 7, 2006 for which all the participants will be available; and (2) inform the Board Chairman by close of official NRC business hours on

Wednesday, June 21, 2006, by e-mail (ask2@nrc.gov, mxc7@nrc.gov, and ksv@nrc) and by normal service on the Board and all participants, of the proposed alternative dates that are acceptable to all other participants for holding oral argument.

As a separate matter, all participants are instructed that all pleadings, documents, and exhibits should be served on Judge Thomas Elleman by: (1) sending the filing as a file attached to an e-mail message to the following address: elleman@eos.ncsu.edu; and (2) sending paper conforming copies that same date via overnight express to the following address: 5207 Creedmoor Road, #101, Raleigh, NC 27612.
