Dear Secretary,

We, the Town of Marlboro, hereby request a hearing during the proceedings to decide upon a license extension for the Entergy Vermont Yankee nuclear power plant in Vernon, VT for the following reasons:

We believe that we have a right to a hearing since part of the Town of Marlboro falls within the ten-mile radius of the above-mentioned nuclear power plant.

The Town of Marlboro was excluded from the Emergency Planning Zone around the power plant when the original license to operate the plant was granted. We strongly believe that this was in error and that the Town has been, and will continue to be, negatively impacted by not being included in the EPZ. The State of Vermont has a whole-town inclusion policy which means that every town in Vermont with any property within the ten-mile radius is completely included in evacuation planning and notification. Marlboro does not get this type of assistance. We feel that this is unfair and discriminatory.

In recent months the Emergency Evacuation officials planning for an evacuation of the VY EPZ have begun designing a Western Evacuation Center to the west of the power plant to accommodate the approximately 25 percent of the local population living to the west of the plant.

This Western Evacuation Center lies to the west of Marlboro and the only route of access to the Center travels through Marlboro. Our volunteers will be a critical part of traffic control and notification in the event of an evacuation, and yet we are not included in the official EPZ. We feel that it is unfair to use the Town of Marlboro's resources without being officially included in the EPZ.

Pg Z:1 If our request for this hearing is denied we believe that the safety and wvell-being of the citizens of Marlboro will be negatively impacted. In our opinion the only fair way to resolve the issue is to require that the entire Town of Marlboro be included in the VY EPZ in any new license issued allowing Entergy VY to operate past 2012. We call on the NRC to address this issue during the proceedings to decide upon the license extension for the VY plant.
