The parties to this proceeding stipulate that the appeal taken in this case by means of the petition for review dated December 15, 2005 and filed with this Court on December 16,2005 by petitioner County of Suffolk may be dismissed.

The parties agree and represent that:

The petition for review in this matter was docketed in this Court on December 16, 2005 and assigned docket number 05-6684-ag.

2.

Counsel, whose signatures appear on this stipulation have authority of their clients to enter into this stipulation to dismiss the appeal herein. This Agreement may be executed in counterparts, each of which when executed shall be deemed to be an original and all of which together shall constitute a single instrument bindinig upon the parties.

3.

The parties agree that each party will bear its own costs.
