Dear Mr. Antrassian:
Your petition to the Nuclear Regulatory Commission (NRC) dated April 5, 2006, addressed to Mr. Luis A. Reyes, Executive Director for Operations, has been referred to the Office of Nuclear Reactor Regulation pursuant to Section 2.206 of Title 10 of the Code of Federal Regulations (10 CFR 2.206). The petition states that union representation at Fermi 2 might, in the future, be divided between the Utility Workers Union of America, which currently represents non-licensed operators, and the International Brotherhood of Electrical Workers which might, in the future, represent licensed operators. The petition requests that the NRC take action as may be proper, pursuant to 10 CFR 2.206, to prevent the operating authority at Fermi 2 from being divided in a manner which hinders and obstructs the preferred, normal, and natural progression of non-licensed operators to licensed reactor operators.
On April 19, 2006, the NRCs Petition Review Board (PRB) met to discuss your petition and whether the petition meets the criteria for consideration under 10 CFR 2.206.
The PRB has concluded that your submittal does not meet the criteria for consideration under 10 CFR 2.206, because matters concerning union representation are beyond the scope of the NRCs regulatory authority under the Atomic Energy Act, as amended. Accordingly, the NRC has rejected your petition for the requested action under 10 CFR 2.206. This conclusion was discussed with you in an April 21, 2006, telephone call from Mr. David H. Jaffe of the NRC staff.
