SUBJECT:

NUCLEAR ENERGY INSTITUTE 05-10, SECURITY FREQUENTLY ASKED QUESTIONS PROCESS, REVISION 2 By letter dated February 7, 2006, you provided Revision 2 of Nuclear Energy Institute (NEI) 05-10, a process previously endorsed by the U.S. Nuclear Regulatory Commission (NRC) for addressing security-related frequently asked questions (SFAQS). A change of significance is that you added a section for implementation which states the following:

SFAQs that involve changes to NEI 03-12 may be implemented immediately if required or desired for site specific reasons. However, the industrys position is that utilities should make changes to their Security Plan, Training and Qualification Plan and Contingency Plan no later than 90 days from the NRCs endorsement of a periodic update to NEI 03-09 Security Officer Training Program and/or NEI 03-12 Template for Security Plan and Training and Qualification Plan. The NRC will be notified of the changes in accordance with the requirements of 10 CFR 50.54p.

We have reviewed your proposed change above, along with other minor administrative changes and found them acceptable. We encourage you to reinforce that power reactor licensees should prudently, in a timely fashion, incorporate the results of SFAQS that ensures clarity of generic security plan commitments which have been found acceptable for meeting regulatory performance requirements. We endorse your proposed revision to NEI 05-10 without conditions.
