I have reviewed NEC Contention 3 and Board's decision to admit the contention dated 11/22/04, and agree with the licensee's view of the contention. Only two tests are at issue in the licensee's requested exception - MSIV closure and generator load rejection; these, in turn, were the basis for NEC Contention 3 and the Board's decision to admit the contention. These are also the only tests addressed in the Staffs response to the licensee's motion for summary disposition of the contention. If NEC wishes to raise a concern about the need to perform any other tests, it should file a new contention.
I am ready to sign a stipulation as outlined by Matt.
