THE ASSEMBLY CESIO STATE OF NEW YORK FRE W.TLE R RANKING MINORITY MEMBER Education Committee ALBANY COMMITTEES Ways and Means FRED W.THIELE, JR. egI . 'IRW Environmental Conservation Assemblyman 2NDDistrict Housing C76Fo I7E) 1X DOCKETED USNRC February 3, 2006 March 6, 2006 (11:00am)

Chairman Nils J. Diaz United States Nuclear Regulatory Commission OFFICE OF SECRETARY RULEMAKINGS AND Washington, D.C. 20555-0001 ADJUDICATIONS STAFF RE: PRM 73-12: Petition by Committee to Bridge the Gap to amend NRC regulations to upgrade the design basis threat regufations

Dear Chairman Diaz:

We are writing to offer our comments on the aforementioned petition presently before your agency. Most specifically, we are supportive of amendments to regulations concerning the "design basis threat" (DBT) and their impact on the Millstone Nuclear Power Station

("Millstone") in furthering the protection of the Long Island residents that we represent in the New York State Legislature.

We have growing concerns that the current DBT regulations are inadequate and fail to provide protection levels that will sufficiently safeguard nuclear facilities from terrorist attacks.

Recently, we were made aware of proposed amendments made by the Petitioner to enhance security at said facilities. As you know, Millstone is located in extremely close proximity to Long Island, namely Suffolk County which is home to over 1.4 million residents. If the NRC fails to enact strong security policies, an attack at Millstone would be devastating to the North and South Forks of Long Island. The NRC must provide visible and impenetrable protection against attacks by land, water, and air.

In summary, we support the recommendations that have been submitted to the NRC by the abovementioned Petitioner. If we can provide any additional information, please do not hesitate to contact us.

Sincerely yours, Kenneth P. LaValle Fred W. Thiele, Jr.. .
