NORTH ANNA POWER STATION, UNIT NOS. 1 AND 2 (NORTH ANNA) AND SURRY POWER STATION, UNIT NOS. 1 AND 2 (SURRY) - CONTAINMENT RELIEF REQUEST IWL1 (TAC NOS. MC8736, MC8737, MC8738, AND MC8739)
By letter dated October 19, 2005, Virginia Electric and Power Company (VEPCO) submitted proposed Relief Request IWL1 for the second 10-year containment inservice inspection (ISI) program at North Anna and Surry. VEPCO is requesting relief from the regulatory requirements of Title 10 of the Code of Federal Regulations (10 CFR), Part 50, Section 50.55a(b)(2)(viii)(F). VEPCO is requesting this relief in order to allow for the Responsible Engineer, described in the American Society of Mechanical Engineers, Boiler and Pressure Vessel Code (ASME Code),Section XI, Paragraph IWL-2320, to perform examinations without meeting the qualification and certification requirements of ASME Code, Paragraph IWA-2300.
The Nuclear Regulatory Commission (NRC) staff has reviewed this submittal and is providing the following comments.

VEPCO requested relief from the requirements of 10 CFR 50.55a(b)(2)(viii)(F) pursuant to 10 CFR 50.55a(a)(3), which states Proposed alternatives to the requirements of paragraphs (c), (d), (e), (f), (g) and (h) of this section... The NRC staff has determined that relief from the cited requirements cannot be granted under 10 CFR 50.55a(a)(3) as the requirement from which relief is sought, is located in 10 CFR 50.55a(b).
In addition, VEPCO stated that this proposed relief was similar to Relief Request IWL3, which was submitted to the NRC staff on February 11, 1999, and subsequently approved on August 23, 1999. However, in Relief Request IWL3, VEPCO requested relief from Subsection IWL of the 1992 edition with the 1992 addenda of ASME Code,Section XI, and not from the requirements of 10 CFR 50.55a. Because the NRC staff can only grant relief from the ASME Code and not from the requirements of 10 CFR 50.55a(b)(2)(viii)(F), Relief Request IWL1 cannot be approved. As such, the NRC staff requests the licensee submit a request for an exemption under 10 CFR 50.12 Specific Exemptions, if justified.

Please clarify how a Responsible Engineer would acquire the proficiency that Nondestructive Testing personnel obtain by following the station procedure that was developed using the standard of the American National Standards Institute/American Society of Nondestructive Testing (ASNT), CP-189, ASNT Standard for Qualification and Certification of Nondestructive Testing Personnel. For example, this experience
includes using the different tools that aid in the identification of degraded concrete, reinforcing and pre-stressing hardware.
VEPCO is requested to provide a submittal superceding the October 19, 2005, letter, requesting an exemption from 10 CFR Part 50 and addressing the NRC staffs comments. The NRC staff has completed its evaluation of this request; and, therefore, we are closing TAC Nos.
