1 The issues to be addressed in this brief were initially raised by the parties, Tr. at 712-713, 715-716, and specified by the Board, Tr. at 731, 739, during the during the January 24, 2006 prehearing conference call. NECs motion incorrectly characterizes the issue to be briefed as the question of which regulations underlie NECs Contention 4. [NECs] Unopposed Motion for Enlargement of Time to File a Brief (Feb. 6, 2006) at 1. The Board encouraged the parties to discuss and attempt to resolve this issue, Tr. at 734-735, but held it in abeyance, and it is not the subject of the ordered briefing. Tr. at 739-740.

The Board grants New England Coalitions (NECs) February 6, 2006, unopposed motion for enlargement of time to file its brief on the question of whether NEC Contention 4 covers only the cooling tower or whether it covers the alternate cooling system.1 NEC shall submit its brief, which shall not exceed ten pages, on or before February 14, 2006. Entergy Nuclear Vermont Yankee L.L.C. and Entergy Nuclear Operations, Inc (collectively, Entergy) and the NRC Staff shall file their answers, which shall not exceed ten pages, on or before February 2 Copies of this order were sent this date by Internet e-mail transmission to counsel for (1) licensees Entergy Nuclear Vermont Yankee, L.L.C.; (2) intervenors Vermont Department of Public Service Department and New England Coalition of Brattleboro; and (3) the NRC Staff.
21, 2006. NEC shall file its reply, which shall not exceed five pages, on or before February 28, 2006. No other deadline or requirement is changed by virtue of this order.
