Dear Mr. Herron:
The Region I Field Office of the NRC Office of Investigations (OI) initiated an investigation (Case No. 1-2005-001) on January 7, 2004, to determine if a deliberate violation of NRC requirements occurred by the issuance of dosimetry to several members of the Entergy Board of Directors without fulfilling the procedural requirements of Indian Point 3 Station Procedure 0-RP-DOS-602, Rev. 0, for issuing dosimetry prior to entry into the radiologically controlled area (RCA).
During the investigation, OI found that the procedure-in-question had a specific condition stating that procedure steps leading to and including issuance of dosimetry did not have to be completed in any particular order. OI also found that all Entergy Board Members who entered the RCA provided radiological dose history information to the Radiological Protection group shortly after their tour completed, and before a related corrective action document was initiated.
Although OI determined that dose history information is normally gathered in advance of granting RCA access, OI concluded that Entergy procedure 0-RP-DOS-602, Rev. 0, clearly did not require such documentation in advance. OI also found that all who entered the RCA, entered with dosimetry, and without delay completed the appropriate dose history information documentation for the entry.
Based on the evidence developed during this investigation, OI could not substantiate that a deliberate violation of NRC requirements and Indian Point 3 Station Procedure 0-RP-DOS-602, Rev. 0, occurred in this instance regarding the issuance of dosimetry prior to entry into the RCA.
