REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FROM MONTICELLO NUCLEAR GENERATING PLANT
Dear Mr. Conway:
By letter (L-MT-05-121) dated December 16, 2005, Nuclear Management Company, LLC (NMC) submitted an affidavit dated November 17, 2005, executed by George B. Stramback of the General Electric Company (GE), requesting the information in GE Proprietary Report 60GL20, ?Investigation of the Sliding Behavior of a Number of Alloys Under Dry and Water Lubricated Conditions, be withheld from public disclosure pursuant to Title 10 Code of Federal Regulations Part 2.390 (10 CFR 2.390(a)(4)). A non-proprietary copy of this document has been placed in the NRCs Public Document Room and added to the Agencywide Documents Access and Management System (ADAMS).
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reason:
The proprietary version of GE Proprietary Report 60GL20, ?Investigation of the Sliding Behavior of a Number of Alloys Under Dry and Water Lubricated Conditions, contains proprietary commercial information which is considered a trade secret that should be held in confidence by the NRC pursuant to the policy reflected in 10 CFR 2.390(a)(4).
We have reviewed your application and the material as required by 10 CFR 2.390 and we have determined that the submitted information sought to be withheld contains proprietary commercial information. As a result, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If in the future, it is determined that the information could be made available for public inspection, you should promptly notify NRC. You should also understand that the NRC may have cause to review this determination in the future if, for example, the scope of a Freedom of
Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
