Dear Mr. Davis:

First I would like to thank the Nuclear Energy Institute (NEI) for their detailed responses to the Nuclear Regulatory Commissions request for public comment on the proposed rulemaking to amend 10 CFR Part 26, Fitness for Duty Programs. The staff is currently in the process of reviewing stakeholder comments and has identified a need for background information concerning one of the comments submitted by NEI on behalf of the nuclear energy industry.

Specifically, NEIs submittal dated December 20, 2005, concerning Subpart I, Fatigue Management, references a study of human performance in the nuclear industry (see pages 14 -

15). The staff has not previously seen this study and is therefore requesting to review the referenced report and supporting data as part of its comment analysis and resolution process.

If possible, please provide the supporting data as an electronic database so that the staff may independently analyze the data if it determines that such an analysis is necessary or appropriate.

It would be greatly appreciated if you could provide the requested materials by January 31, 2006, as it is our objective to complete our comment analysis as soon as possible. Should you have any questions regarding this information request, please contact David Desaulniers at 301-415-1043.
