REVISED EMERGENCY PLAN FOR THE THREE MILE ISLAND UNIT 2 INDEPENDENT SPENT FUEL STORAGE INSTALLATION (DOCKET 72-20)

Dear Ms. Sellers:

By letter dated March 11, 2005, as supplemented September 30, 2005, the Department of Energy (DOE), Idaho Operations Office submitted a proposed revised Emergency Plan for the Three Mile Island Unit 2 (TMI-2) Independent Spent Fuel Storage Installation (ISFSI), Material License SNM-2508. The revised plan is intended to replace the previous plan that was included as an addendum to the site wide emergency plan. The revised plan is a result of removing the TMI-2 plan from the site wide plan so that administration and oversight of the TMI-2 ISFSI emergency plan can be simplified.

We have reviewed the original submittal and DOEs response to our Request for Additional Information and conclude that the changes to the plan do not decrease the effectiveness of the plan. We are issuing this letter and the enclosed Safety Evaluation Report documenting that the revised plan meets the requirements of 10 Code of Federal Regulation 72.32. Because the revisions to the plan do not decrease the effectiveness of the emergency plan, the U.S. Nuclear Regulatory Commission has determined that a license amendment is not required.

SAFETY EVALUATION REPORT THREE MILE ISLAND UNIT 2 INDEPENDENT SPENT FUEL STORAGE INSTALLATION REVISED EMERGENCY PLAN DOCKET NO. 72-20

SUMMARY

By letter dated March 11, 2005, and supplemented September 30, 2005, the Department of Energy - Idaho Operations Office (DOE) submitted to the U.S. Nuclear Regulatory Commission (NRC) a revised Emergency Plan (EP) for the Three Mile Island Unit 2 (TMI-2) Independent Spent Fuel Storage Installation (ISFSI). Staff reviewed the information in accordance with the requirements of 10 Code of Federal Regulation (CFR) Part 72 and concluded that the revisions to the plan do not decrease the effectiveness of the plan.

EVALUATION The TMI-2 ISFSI is located at the Idaho National Laboratory (INL). Under the requirements of 10 CFR 72.32(a), DOE maintains an emergency plan (EP) for the site. The TMI-2 EP is currently an addendum to the INL Emergency Plan/Resource Conservation and Recovery Act Contingency Plan (otherwise referred to as the base-plan). DOE has requested that the TMI-2 EP be removed from the base-plan so that the TMI-2 EP will be a stand-alone document. This is similar to a previous request from DOE for its ISFSI at Fort St. Vrain. The EP has been reviewed and found to meet the requirements in 10 CFR 72.32.

DOE restructured the EP so that it can be a stand-alone document. The purpose of separating the document was to allow for better management of both the TMI-2 ISFSI EP and INL base-plan. The plan will be a stand alone document as a license basis document thereby improving the management and implementation of the EP. The stand-alone TMI-2 ISFSI EP will be referenced in the INL base-plan.

In the event of an accident or emergency at the TMI-2 ISFSI, on-site DOE INL support organizations would provide most of the emergency response activities, such as radiological control, fire suppression, security, etc. Medical aid for severely injured personnel would be provided by off-site medical facilities. The memoranda of understanding and memoranda of agreement with off-site response organizations are included in the INL base plan and are reviewed and revised on a periodic basis.

CONCLUSION Staff has reviewed the TMI-2 ISFSI EP and has determined that it meets the requirements of 10 CFR 72.32(a). Staff has reasonable assurance that the EP would provide adequate guidance to site personnel in the event of an accident or emergency. Accordingly, a letter of approval has been issued to DOE. No amendment to the ISFSI material license is required for this action.
