ENTERGY'S MOTION TO SET SCHEDULE Pursuant to 10 C.F.R. §2.323, Applicants Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. (collectively "Entergy") hereby file this motion requesting that the Atomic Safety and Licensing Board ("Board") set a schedule for the filing of a Motion for Summary Disposition of New England Coalition ("NEC") Modified Contention 4, which was admitted by the Board on December 2, 2005. Memorandum and Order (Admitting Intervenor's New Contention), LBP-05-32, 62 NRC (2005).
The Board's Initial Scheduling Order in this proceeding set as the deadline filing motions for summary disposition 30 days after the issuance by the Staff of the Draft Safety Evaluation Report ("Draft SER") for the extended power uprate sought by Entergy. Initial Scheduling Order (Feb. 1, 2005) at 3. The Initial Scheduling Order, however, did not establish a schedule for filing motions for summary disposition for contentions, such as NEC Modified Contention 4, which are admitted 30 days or more after the issuance of the Draft SER.'
On the other hand, the applicable provision in Subpart L of 10 C.F.R. Part 2 states: "(a) Unless the presiding officer The Draft SER was posted on ADAMS on November 2, 2005 (Accession Number ML053010167).

or the Commission directs otherwise, motions for summary disposition may be submitted to the presiding officer by any party no later than forty-five (45) days before the commencement of hearing." 10 C.F.R. §2.1205(a).
Entergy hereby respectfully requests that the Board set the deadline for filing a motion for summary disposition of NEC Modified Contention 4 as: 20 days after the issuance of the Final Safety Evaluation Report. The deadline for filing answers, either supporting or opposing the motion, would remain as set forth in 10 C.F.R. §2.1205(b), i.e., 20 days after service of the motion.
CONCLUSION For the reasons stated above, Entergy requests that the Board issue the schedule requested herein.
CERTIFICATION In accordance with 10 C.F.R. §2.323(b), counsel for Entergy has discussed this motion with counsel for the other parties in this proceeding in an attempt to resolve this issue. Counsel for the NRC Staff indicated that the Staff would not object to the relief requested. NEC's representative stated that NEC could not take a position on this motion at this time.
