ACKNOWLEDGMENT OF REQUEST FOR RELIEF FROM THE 10 CFR PART 50.70(b)(1) FOR THE BIG ROCK POINT FACILITY

Dear Mr. Haas:

The U.S. Nuclear Regulatory Commission (NRC) staff has received your request dated October 25, 2005, that requested relief from the 10 CFR Part 50.70(b)(1) requirement for the Big Rock Point (BRP)site to provide rent-free space for the exclusive use of Commission inspection personnel.

We have completed the initial processing, which is an administrative review, and have accepted your request for a more detailed technical review. The more detailed technical review may identify omissions in the submitted information or technical issues that will result in a Request for Additional Information (RAI). If required, these will be forwarded to you under separate cover. The staff expects to complete its review by January, 2006. This schedule assumes no RAIs are required.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Document Access Management System (ADAMS). ADAMS is accessible from the NRC Web site: http://www.nrc.gov.reading-rm/adams.html.
