Dear Mr. Heymer:
I am responding to your September 22, 2005, letter requesting a fee waiver under 10 CFR 170.11 for review of the Electrical Power Research Institute (EPRI) Topical Report (TR) 1009684, CEUS Ground Motion Project Final Report. For the reason stated below, I am granting a fee waiver for the Nuclear Regulatory Commission (NRC) technical staffs review of this Report in accordance with the applicable provisions of 10 CFR 170.11.
The staff has determined that the review of this TR will support the NRCs generic regulatory improvements. This is because this report is being used as a basis in the development of improvements to the Regulatory Guide 1.165 methodology for determining seismic ground motion. As stated in 10 CFR 170.11(a)(1)(iii)(A)(1) and (2), fees are not required for a report that the NRC plans to use, at the time the document is submitted, for the specific purpose of supporting the NRCs development of generic guidance and regulations (e.g., rules, regulations, guides and policy statements). Therefore, this submittal meets the fee exemption requirements stated in 10 CFR 170.11(a)(1)(iii).
