TERMINATION OF THE SAXTON NUCLEAR EXPERIMENTAL CORPORATION SITE LICENSE

Dear Mr. Cook:

I am writing to inform you of the termination of the U.S. Nuclear Regulatory Commission (NRC) license for the Saxton Nuclear Experimental Corporation (Saxton) site in Liberty Township, Bedford County, Pennsylvania. NRC License No. DPR-4 was terminated on November 7, 2005. The termination letter is available in NRCs electronic reading room, at http://www.nrc.gov/reading-rm/adams.html (ML052660419).

NRC notified you of the decommissioning activities at Saxton in a letter dated March 5, 2004.

The letter provided notification that the Saxton License Termination Plan (LTP) contained approved Derived Concentration Guideline Levels that exceeded the values for two radionuclides (Cesium-137 and Europium-152) in Table 1 of the Memorandum of Understanding (MOU) entitled Consultation and Finality on Decommissioning and Decontamination of Contaminated Sites, entered into by NRC and the U.S. Environmental Protection Agency in October 2002.

NRC conducted a number of on-site inspections of the licensees actions during the decommissioning process to verify that decommissioning and cleanup were being conducted as described in the LTP and to evaluate the quality of this activity. NRC also conducted independent measurements to verify the companys final radiation surveys. NRC has concluded that: (1) dismantlement and decontamination activities were performed in accordance with the approved LTP; and (2) the final status surveys (FSSs) and associated documentation demonstrated that the facility and site met the criteria for decommissioning in 10 CFR Part 20 of the Commissions regulations, and were suitable for release for unrestricted use.

As part of the review of the information contained in the FSS reports, NRC staff compared the actual remaining levels of residual radioactivity to the consultation trigger levels in the MOU. No FSS measurements exceeded the trigger levels of the MOU. Therefore, a Level 2 consultation under the MOU between the agencies was unnecessary.
