NOTICE OF VIOLATION (SEVERITY LEVEL III) AND PROPOSED IMPOSITION OF CIVIL PENALTY - $60,000 This is to inform the Commission that a Severity Level III Notice of Violation, with a proposed
$60,000 civil penalty, will be issued on or about November 23, 2005, to the Indiana Michigan Power Company as a result several issues involving the licensees failure to provide complete and accurate information, and meet reporting requirements regarding NRC-licensed operators at the Donald C. Cook Nuclear Plant (D. C. Cook). The issues include the licensees failure to:
(1) provide complete and accurate information to the NRC concerning corrective actions associated with a September 29, 2004, Severity Level III violation (EA-04-109); (2) notify the NRC within 30 days of NRC-licensed operators experiencing a permanent disability or illness; and (3) provide complete and accurate information concerning the medical condition of individuals on new or renewal NRC reactor operator license applications. The September 2004 Severity Level III violation also involved D. C. Cooks failure to notify the NRC within 30 days after a licensed operator developed a permanent disability or illness and failure to provide the NRC with complete and accurate information about a licensed operators medical condition.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
