Dear Mr. Kouhestani:

I have received your letter which proposes certain ground rules to allow NIOSH access to Nuclear Regulation Commission records. NIOSH agrees to follow the ground rules as provided in your response letter.

In your response letter dated October 26, 2005, it is mentioned that the scope of the request is limited to that stated in HHS/NIOSH's August 11, 2005 letter. We did want to clarify that we are also interested in obtaining records from the Westinghouse Nuclear Fuels Division in Cheswick, Pennsylvania facility as specifically mentioned in the August.11, 2005 letter. -We only bring up this point because your response letter specifically discusses Nuclear Materials and Equipment Company facilities in Apollo and Parks Township, Pennsylvania but makes no mention of the Westinghouse Nuclear Fuels Division in Cheswick, Pennsylvania facility.

NIOSH is looking forward to working with your agency and appreciate the cooperation received thus far in this matter.
