(:A Lo 3 0l The cover letter and Draft Rev 1 of the Safety Evaluation are attached for your information. Relative to the dose to the public issue, the cover letter states the following:

"NRC Region I staff, with support from NRC Headquarters staff, are currently evaluating the direct dose calculation methodology described in the VYNPS Offsite Dose Calculation Manual (ODCM). This issue will be included in an upcoming baseline inspection. The purpose of the ODCM review will be to ensure that the dose to a member of the public meets the Environmental Protection Agency's 25 millirem per year limit specified in Title4O of the Code of Federal Regulations Section 190, and referenced in 10 CFR 20.1301(e), both during current plant operation as well as under EPU conditions. This issue may impact the current writeup in SE Section 2.10.1."

While our inspections have not identified any failure of the licensee to conform with NRC regulatory requirements, to date, our review of the calculational method remains inconclusive pending additional information and clarification needed from the licensee on certain aspects.

In a telecon with W on 11/2/05, we identified these matters and remaining questions that need to be resolved in order to for the NRC to arrive at a final determination on the calculational method.

Jim and a representative of NRR will be going to the site next week for a day to assure that the licensee understands the questions that remain to be answered relative to the calculational method, and to gather any additional information that would be useful for resolution of this matter. You are welcome to attend, as well as accompany our next baseline inspection on December 5, 2005. Our intent is come to a conclusion on this matter ASAP.
