RESPONSE TO YOUR LETTER REGARDING PERFORMANCE AT THE INDIAN POINT ENERGY CENTER

Dear Mr. Flynn:

I am writing in response to your letter to NRC Chairman Diaz dated October 14, 2005, and to affirm our telephone conversation on November 9, 2005, concerning the Indian Point Energy Center (IPEC) in Buchanan, New York. In your letter, you expressed concerns about the reliability of Indian Point and recent reports about operation and maintenance issues at the site.

During our telephone conversation, you indicated that a meeting will be set to discuss Indian Point issues, and I committed that NRC Region I will participate in the meeting.

As we discussed, the NRC staff would be happy to explain our assessment of the safety performance at Indian Point. Our process for assessing the safety performance of all nuclear power plants is designed to be transparent and we are committed to openness in our regulatory process. Mr. Brian McDermott, Chief, Projects Branch 2, is the NRC Region I point of contact regarding Indian Point issues and he will work with your staff to ensure appropriate NRC representation at the meeting.
