Our process allows 120 days from the date of the acknowledgment letter (that formally accepts the petition) to issue a propsed response. The petitioners then have 30 days to review and comment on the proposed response.
The staff must then address all the comments it receives before issuing the final Director's Decision.
During the 120 days, the staff may ask the licensee to provide information to help the staff in its evaluation, or may request additional meetings with the petitioner to clarify information in the petition. Any additional information, from the petitioners or others, that is provided during the review period will be considered by the staff as it evaluates the issues discussed in the petition.
Although our internal processes allow for 120 days, the staff attempts to answer all petitions as expeditiously as possible. In some cases, a longer time is required if additional information is received or the staff's decision is dependent on other ongoing processes such as an inspection or investigation.
We have not developed a strategy or schedule for review of the VY petition yet.
