Re: Brattleboro Reformer FYI - I provided similar information regarding the "Certificate of Public Good" this morning to Erika Cohen of the Keene Sentinel. I've had several calls with her over the past few weeks and she plans on doing several articles on the VY EPU prior to the PSB 3/15 decision.

With regard to the NRC's ability to 'trump" the state, it's important to note that the state's Public Service Commission will make a decision based primarily on the economics of an uprate (and safety issues factor into that), while we focus on the safety implications. Is she any relation to Peter Lorie?

She asked two questions regarding VY's proposed uprate: are NPPs in other states required to seek "Certificates of Public Good" from state govts for uprates? And, can NRC "trump" a 'No" vote from the state?
After consulting Rick Ennis of NRR, I called her back and informed her that no, some other states have similar arrangements, though state laws vary; and no, we cannot 'trump' the state because VY needs state permission to make certain changes necessary as prerequisites to an uprate.
As she thanked me, I said, 'See, we aren't so bad!' She winced, audibly, and said, 'I didn't say thatl! I replied, "But you put it in the lead and let it stand there unrefuted. We notice these things."
That is all. I feel better now.
