Subject:

Notification of Intent to Modify Request to Release a Portion of the Yankee Nuclear Power Station Site Property from the Part 50 License

Dear Madam/Sir:

This letter provides written notification to the Nuclear Regulatory Commission (NRC) of Yankee Atomic Electric Company's (YAEC's) intent to modify its previously submitted request to release aiportion of the site from its 10 CFR Part 50 License (DPR-3).

YAEC recently identified 'the need to designate an area of the site for the temporary storage of waste containers which are being'prepared for transportation offsite. Because of the compact nature of the Industrial Area and the large number of decommissioning activities being worked concurrently in that area, YAEC has chosen an area outside of the Industrial Area for this purpose. The selected area, an approximately one acre parcel adjacent to Monroe Hill Road, was previously identified as being a "non-impacted area" and was included in YAEC's January 3, 2005, request for release from the Part 50 license.

Recently, consistent with its intended use as a waste container temporary storage area, this area has been redesignated as an "impacted area" and has been identified as Survey Area OOL-18. Because of the change in designation for this area and its anticipated continued use during decommissioning, YAEC wishes to withdraw this area (as identified on the attached figure) from the previous release request.

YAEC has reviewed the release request submittal and has determined that the information and 'conclusions provided therein remain valid. However,:YAEC does wish to note that the land previously identified as being owned by USGen New England, Inc.,

is now owned by TrarsCanada' ' ' -  :

We request that the NRC review and concur with the acceptability of the release of the subject land from the YNPS Part 50 license by October 31, 2005. If you should have any questions regarding this submiittal, please contact Ms. A. Caison, Licensing Manager at (301) 916-3995.

Very truly yours, YANKEE ATOMIC ELECTRIC COMPANY Richard M. Kacich President acc/acc
