Cowan (AmerGen Energy Company, LLC) to U.S. Nuclear Regulatory Commission, dated September 26, 2005 In the referenced letters, AmerGen Energy Company, LLC (AmerGen) requested relief from the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code,Section XI, Rules for lnservice Inspection of Nuclear Power Plant Components, on the basis that the proposed alternative provides an acceptable level of quality and safety. Specifically, this proposed alternative concerns the use of Code Case N-638-1.
On September 29, 2005, the Nuclear Regulatory Commission (NRC) amended its regulations (70 FR 56809) to incorporate by reference NRC Regulatory Guides listing Code Cases published by ASME. Specifically, the NRC approved the use of Regulatory Guide 1.147, Inservice Inspection Code Case Acceptability, ASME Section XI, Division 1, Revision 14, as of October 31, 2005. Regulatory Guide 1.1 47, Revision 14, includes Code Case N-638-1.
Accordingly, this request for relief is no longer necessary.
