RE: Texas response to NRC EA for CT Yankee Ted, In as much as Waste Control Specialist (WCS) was notified In a letter dated August 30, 2005, signed by Albert Hawkins, Executive Commissioner for the Texas Health and Human Services Commission, that WCS' request petitioning for rulemaking dated June 30, 2005, was denied, the Department of State Health Services finds insufficient reason to offer additional comments as they relate to your licensed activities associated with Connecticut Yankee and WCS. However, we appreciate this additional opportunity.

Re: Texas response to NRC EA for CT Yankee David Wood, Thanks for emailing me a response to the draft EA I provided. Your response indicates that the State of Texas cannot accept this waste as it is not allowed under WCS's current RCRA permit.

I understand that WCS has a request in with the State of TX that would be relevant to this material, dated June 30, 2005. The request is to allow disposal of NRC exempted material at their Andrews, Texas facility. Given that Texas has this request from WCS, are there any further comments Texas would like to make on the draft environmental assessment?
