ASLBP No. 04-832-02-OLA VERMONT DEPARTMENT OF PUBLIC SERVICE REQUEST FOR ORAL ARGUMENT OR, ALTERNATIVELY, FOR LEAVE TO FILE A REQUEST TO FILE A REPLY BRIEF On August 31, 2005, the Vermont Department of Public Service (DPS) filed its Motion to Compel Production of Certain NRC Staff Documents. On September 12, 2005, the NRC Staff filed its Opposition to the Motion. In its Opposition the Staff made several arguments that warrant a response. DPS requests the Board schedule an oral argument (telephone would be fine) to allow DPS to respond to the Staff arguments and to answer any questions the Board may have.
Alternatively, if the Board does not schedule an oral argument, DPS requests a brief time, after that decision, to submit a request, pursuant to 10 CFR § 2.323(c), for leave to file a reply brief.
