12/11/2002 Confidentiality Granted: No Issue discussed: The alleger was originally concerned with his ability to perform duties in accordance with the Transient Assessment Response Plan (TARP) team formation procedure.
When contacted by 01 he chose not be interviewed and stated that he would try to resolve his concerns within the PSEG corrective action process. The NRC issued a conditional closeout letter to the alleger stating that the NRC will consider this allegation closed unless he contacts us within 30 days of the date of the letter. He did contact NRC in a November 20, 2002, letter and stated that he wanted the NRC to keep the issue open.

The alleger responded to the conditional closeout letter and acknowledged that PSEG was reviewing his concerns with the corrective action process. However, in his November 20, 2002, letter he stated that he wanted the NRC to keep the issue open.
Branch 3 is recommending that the issue be administratively closed since he would still have the ability to raise his concerns at some future time. Branch 3 to provide words for to closeout letter.

SAFETY SIGNIFICANCE ASSESSMENT: The risk significance of this concern appears very low since the alleger agreed no immediate safety issues remain at this time, and will pursue his remaining concerns within the PSEG corrective action process.
PRIORITY OF 01 INVESTIGATION: Alleger declined to have the NRC pursue his discrimination issue.
