1/8/2003 Confidentiality Granted: No Issue discussed: The alleger was originally concerned with his ability to perform duties in accordance with the Transient Assessment Response Plan (TARP) team formation procedure.

When contacted by 01 he chose not be interviewed and stated that he would try to resolve his concerns within the PSEG corrective action process. The NRC issued a conditional closeout letter to the alleger stating that the NRC will consider this allegation closed unless he contacts us within 30 days of the date of the letter. He did contact NRC in a November 20, 2002, letter and stated that he wanted the NRC to keep the issue open.

In a telephone call and subsequent letter dated 12/20102, the alleger wants the NRC to pursue his H&l claim and wants to address the TARP issue.

SAFETY SIGNIFICANCE ASSESSMENT: Potential H&l. The risk significance of this concern appears low since the alleger's concern involves his ability to function as an effective member of a TARP team. His contention is that the procedure is inadequate because it does not list specific training and/or experience requirements, and if the procedure did list these requirements, then he believes that he not meet them (a subjective judgement).

2 PRIORITY OF 01 INVESTIGATION:

Normal Alleger initially declined to have the NRC pursue his discrimination issue. Thus, 01 Case 1-2002-033 was closed since the alleger agreed no immediate safety issues existed when he was contacted by 0I. During this initial contact, he told 01 he did not want to be interviewed. In his 12/20 letter, no new technical information was provided to warrant raising Of's priority on this case.
