Dear Sir/Madam:
In accordance with N.J.A.C. 7:1E-5.8, PSEG Nuclear LLC ("PSEG Nuclear") is submitting the enclosed discharge confirmation report. This report describes the suspected release of approximately one (1) pint of water-based paint during a sudden thunderstorm. The discharge was reported to the New Jersey Department of Environmental Protection (NJDEP) hotline and assigned case number 05-08-08-1532-
- 47. This discharge was also reported to the Nuclear Regulatory Commission pursuant to that agency's requirements.
The enclosed report contains the information as known at the time of this report. In accordance with the regulations, additional information regarding this discharge will be provided as it becomes available.

Upon observing the paint being washed onto the ground, painters immediately worked to contain and collect the paint/water mixture. However, some of this paint/water mixture is believed to have reached the traveling screen debris return trough for the station's cooling water intake structure, which leads to the Delaware River.

The location of the Circulating Water Building is identified on the Site Map in Attachment B.

Common Name and CAS No. of Hazardous Substance Discharged The approximate volume of paint discharged was one (1) pint. Upon review of the manufacturer's Material Safety Data Sheet (MSDS) (See attachment D), there is only one DPCC Appendix A chemical listed. That chemical is Ethylene Glycol, CAS# 107-21-1.
The MSDS lists the amount of Ethylene Glycol in the paint to be between one (1) and ten (10) percent.
PSEG Nuclear therefore believes that the amount of Ethylene Glycol discharged is in the range of 0.16 to 1.6 ounces.

Detailed Description of Containment, Cleanup and Removal Measures, Summary of Costs Incurred After discovering that the water-based paint was being washed away by the rain, the painters took immediate action to contain the run-off. Absorbent was used to collect the paint/water mix on the paved area.
Wet-vacuums were then used to collect the paint/water/absorbent mix after the storm had passed. The discharge was eliminated and all the paint was cleaned up from the ground by 1601 on August 8, 2005. There was no visible discoloration at the discharge of the traveling screen debris return trough. Based upon visual observation and the small amount of ethylene glycol, it is believed there was little to no threat to human health or the environment. A summary of final costs is not yet 4
LR-E05-0420 available, but will be provided to the Department upon request as soon as it becomes available.

Corrective Actions - Preventative Measures PSEG Nuclear held a meeting with the painting crew on August 9, 2005 to discuss the event and to discuss ways in which they could prevent reoccurrence in the future. PSEG Nuclear is also reviewing the planning of painting activities to reduce the possibility of paint being washed off by the rain. The painters will continue to keep absorbent at the worksite to deal with any potential discharges. Further steps to prevent reoccurrence will be identified, developed and implemented following completion of the investigation of the incident.

Description of Sample Date, Type, Ouantitv and Location Given the small amount of water-based paint that washed off of the wall, the small amount of hazardous substances in that paint and the speed with which it was contained and removed, no samples were collected. Any material could be identified for removal by visual determinations because it is paint.

On behalf of our wholly owned operating subsidiaries, PSEG Fossil LLC and PSEG Nuclear LLC, guarantor guarantees to the Department and to any and all third parties that:
In the event that PSEG Fossil LLC or PS:EG Nuclear LLC, fails to provide alternate coverage within 60 days after receipi of a notice of cancellation of this guarantee and the Department has determined or suspects that a discharge has occuired at a facility covered by this guarantee, the guarantor, upon instructions from the Department, shall fund a standby trust fund in an amount sufficient to cover cleanup and removal costs, but notto exceed the coverage limits specified in N.J.A.C. 7: E-4.4(b).
In the evcnt that the Department determines that PSEG Fossil LILC or PSEG Nuclear LLC has failed to perform cleanup and removal activities arising out of the operation of the above-identified facilities, The guarantor, upon written instructions from the Department, shall fund a standby trust in an amount sufficient to cover cleanup and yernoval costs, but not to exceed the coverage limits.specified above.

Guarantor agrees that if, at the end of any fiscal year before caricllation of this guarantee, the guarantor fails to meet the financial test criteria of N.J.A.C. 7: IE-4.4(g), guarantor shall send within 120 days uf such failure, by certified mail, notice to PSEG Fossil LLC and PSEG Nuclear LLC and the Departmcnt. The guarantee will terminate 120 days from the date of receipt of the notice by PSEG Fossil LLC and PSEG Nuclear LLC or 120 days from the date of receipt of the notice by the Department, whichever is later, as evidenced by the return receipt.

Guarantor agrees to notify PSEG Fossil LLC and PSEG NucleaT LLC by certified mail of a voluntary or involuntary proceeding under Title 1I (Bankcruptcy), U.S.
Code, naming guarantor as debtor, within I 0 days after commencement of the proceeding.
(6)
Guarantor agrees to remain bound under this guarantee notwithstanding any modification or alternation of any obligation of PSEG Fossil LLC or PSEG Nuclear LLC, pursuant to N.J.A.C. 7:IE.
(7)
GuarantoT agrees to remain bound under this guarantee for so long as PSEG Fossil LLC or PSEG Nuclear LLC must comply with the applicable financial responsibility requirements of N.J.A.C. 7:IE-4.4 for the above-iaentified facilities, except that guarantor may cancel this guarantee by sending notice by certified mail to PSEG Fossil LLC and PSEG Nuclear LLC, and the Department, such cancellation to become effective no earlier than.120 days after receipt of such notice by PSEG Fossil LLC and PSEG Nuclear LLC, as evidenced by the return receipt.

The guarantor's obligation does not apply to any of the following:
(a)
Any obligation of PSEG Fossil LLC or PSEG Nuclear LLC, under a worker's compensation, disability benefits, or unemployment compensation law or other similar law; (b)
Bodily injury to an employee of PSEG Fossil LLC or PSEG Nuclear LLC, arising from, and in the course of, employment by PSEG Fossil LLC or PSEG Nuclear LLC;-
(c)
Bodily injury or property damage not Telated to a discharge arising from the ownership, maintenance, use, or entrustment to oihers of any aircraft, motor vehicle, or watercraft; (d)
Property damage to any property owned, rented, loaned to, in the care, custody, or coutrol of, or occupied by PSEG Fossil LLC or PSEG Nuclear LLC that is not the direct result of a discharge from the facility; (e)
Bodily damage or property damage for which PSEG Fossil LLC or PSEG Nuclear LLC is obligated to pay damages by reason of the assumption of liability in a contract or agreement other than a contract or agrcement entered into to meet the requirements of NJA.C. 7:1 E-4.4.
