CLARIFICATION OF CONFIRMATORY ORDER
Dear Ms. Gray:
By letter dated July 15, 2005, the U.S. Nuclear Regulatory Commission (NRC) issued a Confirmatory Order to AVI Food Systems, Inc. (AVI) in order to ensure that AVIs process for addressing employee protection and safety conscious work environment will be enhanced.
As required by Section V of the Order, AVI is to include in its policy/programs, information necessary to ensure that its future activities with NRC licensees will incorporate training for its employees involved with the NRC licensees regarding employee protection, safety conscious work environment, and safety culture.
It is not the intent of the NRC that AVI ensure its employees are given the training outlined in the Order simply because they work at a facility that possesses or holds an NRC license (i.e., hospitals, gauge companies, etc.). Rather, the Order requirements apply to AVI employees who work in, or have been granted unescorted access to: (1) nuclear power plant or fuel cycle facility protected areas, or (2) those portions of an NRC-licensed facility that manufactures, receives, possesses, uses, or transfers material licensed by the NRC.
