La Crosse Boiling Water Reactor (LACBWR)

Possession-Only License No. DPR-45 Notice of Chan-e of Decommissioning Schedule

REFERENCE:

10 CFR 50.82(a)(7),

LACBWR permanently ceased operation on April 30, 1987, with reactor defueling completed on June 11; 1987. The NRC Order authorizing decommissioning was issued August 7, 1991. This order included approval of the Decommissioning Plan for implementation. The SAFSTOR Decommissioning Plan is accepted as the post-shutdown decommissioning activities report (PSDAR) under 10 CFR 50.82. A Confirmatory Order, dated September 15, 1994, modified the decommissioning order to allow changes in the facility or procedures as described in the Safety Analysis Report, and to conduct tests or experiments not described in the Safety Analysis Report, without prior NRC approval, if a plant-specific safety and environmental review procedure containing similar requirements as specified in 10 CFR 50.59 was applied.

The Decommissioning Plan discusses and provides for removal of unused equipment and plant system components, in accordance with 10 CFR 50.59, during SAFSTOR The reactorpressure vessel removal is not specifically addressed in the decommissioning plan schedule. The removal of this large component, as defined in 10 CFR 50.2, is an activity requiring notice be made pursuant to § 50.82 Termination of License, (a)(7), which states:

"In taking actions permitted under § 50.59 following submittal of the PSDAR, the licensee shall notify the NRC, in writing and send a copy to the affected State(s),

before.performing any decommissioning activityinconsistent with, or making any significant schedule change from, those actions and schedules described in the PSDAR, including changes that significantly increase the decommissioning cost."

NRC Document Control Desk LAC-13879 Page 2 August 18,2005 Based on a feasibility study, DPC is entering into a contract agreement with Duratek, Inc. for the removal and subsequent disposal of the intact reactor pressure vessel at the Barnwell Waste Management Facility. The reactor pressure vessel disposal is expected to be completed in the spring of 2007. DPC has included in the scope of work during this project removal of irradiated hardware and other B&C wastes.
