MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN-FERMI POWER PLANT

Dear Mr. OConnor:

On August 9, 2005, the NRC staff completed its performance review of the Fermi Power Plant for the first half of the calendar year 2005 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous 12 months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked as Exempt from Public Disclosure in Accordance with 10 CFR 2.390 will include the physical protection review and a resultant inspection plan.

Plant performance for the most recent quarter was within the Licensee Response column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). Therefore, we plan to conduct only reactor oversight process (ROP) baseline inspections at your facility through March 31, 2007.

In our Annual Assessment Letter dated March 2, 2005, we advised you of a cross-cutting human performance issue in the personnel area. During this assessment period, the staff continued to identify findings with cross-cutting aspects in the area of human performance. In the past six months, inspectors identified seven Green findings where human performance was inadequate. One was attributed to organization, and six were attributed to inadequate personnel performance. Five of these findings were in the reactor safety strategic performance area, three in the mitigating systems cornerstone, and two in the emergency preparedness cornerstone; and one other finding in the public radiation safety cornerstone. The finding attributed to human performance organization was in the emergency preparedness cornerstone. Therefore, the staff has concluded that the area of human performance continues to be a substantive cross-cutting issue.

W. OConnor, Jr. In response to the identification of human performance deficiencies, you have performed several immediate corrective actions. Additionally, you have planned several long-term corrective actions. You are requested to provide us with a letter, within 30 days of the receipt of this letter, which details the actions you have taken to date to address this long-standing substantive cross-cutting issue as well as your future planned actions with your implementation schedule.

The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through March 31, 2007. Significant inspections planned for this year include the Biennial Problem Identification and Resolution Inspection in October 2005, a Biennial Safety System Design and Performance Inspection in November 2005 and an Initial Operator Exam in February 2006. The inspection plan is provided to minimize the resource impact on your staff and to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle review meeting.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
